Terms of Service

Version of 2026-11-05

This is a translation for convenience. The Czech version is binding.

1. Introduction

These terms govern services provided under the Desire Agency brand. The provider is whichever of these sole traders is named in the proposal or contract: Alena Kamalova, Company ID 19536259, registered office Žitomírská 640/3, Vršovice, 101 00 Praha 10 and Daria Loshchakova, Company ID 08692181, registered office Nad Turbovou 1194/21, Košíře, 150 00 Praha 5 (the "agency"). Contact: desire.smm.prague@gmail.com.

They cover social media management, content creation and related services. Provisions marked for consumers apply only to people acting outside their business. Different terms agreed in a contract take precedence.

2. Forming a contract

The website takes no orders or payments. Sending a form is a non-binding enquiry and does not create a contract.

After an enquiry we send you an individual proposal with scope, price and dates. A contract is formed when it is confirmed in writing, including by email.

3. Price and payment

Prices are not listed on the website because they depend on scope. A proposal always states the total price with all taxes and fees and every additional cost, such as travel, props or ad budget. Consumers are quoted the final price with all taxes. The agency is not a VAT payer, so no VAT is added.

Due dates and payment methods are in the proposal or invoice. No service is set up as an automatically renewing subscription unless the contract expressly says so.

4. Services and cooperation

The agency provides services with professional care, in the scope and on the dates in the contract. The client provides the materials, access and approvals needed on time and is responsible for having the rights to what it supplies. Targeted advertising is handled by an external team the agency works with.

5. Copyright

The contract sets the scope of the licence to the content created. Unless agreed otherwise, the client receives the licence once the price is paid in full, for the purposes set out in the contract. The agency may use the content in its portfolio unless agreed otherwise with the client. The client is told when part of the content is created with artificial intelligence.

6. 14-day right of withdrawal (consumers)

A consumer who concluded a contract at a distance (for example by email) may withdraw without giving a reason within 14 days of concluding it (Section 1829 of the Czech Civil Code). The deadline is met if the notice is sent within it.

Send your withdrawal to desire.smm.prague@gmail.com or to the provider's registered office. You may use the model below, but you do not have to.

We refund you within 14 days of receiving the withdrawal, in the way we received the money, unless we agree otherwise.

If you expressly asked us to start before the period ended and then withdraw, you pay a proportionate part of the price for what was already provided (Section 1834). If the service was fully provided before the period ended with your prior express consent, the right of withdrawal ends (Section 1837(a)). The same applies to digital content under Section 1837(l) and to goods made to your specification under Section 1837(d).

  • Model. To: the provider named in the contract, desire.smm.prague@gmail.com.
  • I hereby withdraw from the contract for the following service: ____________
  • Date the contract was concluded: ____________
  • Consumer's name and address: ____________
  • Date and signature (paper only): ____________

7. Complaints

Report defects without undue delay to desire.smm.prague@gmail.com. Say what the complaint concerns, what you consider the defect to be and what remedy you want.

We confirm receipt. For consumers we settle it within 30 days of the complaint (Section 19 of Act No. 634/1992 Coll.), unless we agree a longer period, and confirm the outcome in writing. Depending on the defect we offer correction or rework, or a reasonable discount or withdrawal as the law provides.

Defects concern the agreed scope and quality. The agency does not guarantee a specific number of followers, reach or sales unless expressly agreed, since these also depend on platforms and the market.

8. Liability

The agency is liable for damage as the law provides. It is not liable for changes or outages of third-party platforms or their decisions, such as blocking accounts or ads, unless it caused them. Consumer rights that cannot be excluded by contract are not affected.

9. Out-of-court dispute resolution (consumers)

Consumers may resolve disputes out of court through the Czech Trade Inspection Authority, Štěpánská 15, 120 00 Prague 2, www.coi.cz/adr. Consumer protection is supervised by the Czech Trade Inspection Authority and trade licensing by the competent trade office.

10. Personal data

The Privacy Policy describes how personal data is processed.

11. Final provisions

The contract and these terms are governed by Czech law. This does not affect protection given to a consumer by mandatory rules of their country of residence. The Czech version is binding. The version in force on the day the contract is concluded applies to it.
